Description

A wide range of legal papers, including much material on trade mark infringement, encompassing:

deeds, leases, and plans relating to various properties including Brockwell Hall, Phoenix Mills (Dartford), Euston Road, and other premises;

numerous signed and sealed Powers of Attorney relating to the running of Wellcome Foundation companies at home and abroad;

papers concerning trade mark registration and various intellectual property matters, including infringement;

extensive correspondence with Inland Revenue concerning Medicine Stamp Duty;

various files concerning the Kepler Malt Extract Co Ltd - Articles of Association, share certificates, balance sheets, liquidation papers (1879-1910);

detailed sets of papers relating to various court actions, notably, but not exclusively:
John Roger v Henry Solomon Wellcome (1895) - concerning Tabloid tea patent;
Burroughs Wellcome & Co v Farmacia Centrale Dompe (1901) - infringement of trade marks in Italy;
Burroughs Wellcome & Co v Thompson & Capper (1903-04) - the landmark "Tabloid case" which established once and for all that "tabloid" could not be used freely in a generic descriptive manner but only in relation to certain products manufactured by BW&Co;
Henry Wellcome v William Wilson (1904) - infringement of trade mark "Tabloid" by the use of the name "Tabuloid";
Rex v George Thomas Millership and James Midford Millership (1906) - fraud against BW&Co;
"Glasgow Spy Case" (1912) - Dr Armgaard Karl Graves was arrested at Central Station Hotel, Glasgow (14 April, 1912) on suspicion of spying, tried under the Official Secrets Act, and found guilty; amongst his possessions on arrest was a Burroughs Wellcome & Co notebook, in which a code was concealed;
Ring Irish College case (1937) - litigation following the death, from miliary tuberculosis, of a student vaccinated against diphtheria.

Appraisal note

This accession was selected from a series of 50 boxes referred to as 'Enfield' (as most of it was formerly stored at a Wellcome site at Enfield before being transferred to Berkhamsted). From this series, 13 boxes and further individual items of filing of the Marketing Division were not retained (as routine records of day-to-day work). The Marketing Division files which have been retained are primarily of informational value, and include files of regulatory significance.
